Patrick, what kind of company is Mariënbergh? How do you differ from other collection agencies?
"At Mariënbergh, the emphasis is on the amicable collection process, where the amount of the claim makes no difference to us. We are on top of things, digging up the whole case from A to Z and doing everything possible to achieve a satisfactory result in the amicable collection process. Our collection process is therefore tailor-made. We do everything possible to avoid legal proceedings. Why do we do that? These days it costs an awful lot of time and money to go to court, it does not benefit the client and the costs really skyrocket. That is why we, together with the team, are committed to collecting claims amicably and, of course, within the applicable laws and regulations."
Can you give an example of a successful collection process?
"Some time ago, we were called in to handle a very substantial and complicated claim against a transport company for collection. This client's invoices were not paid for unclear reasons. After the client and its then collection intermediary failed to collect the claim, our company came into the picture. We started consultations with this client, took possession of the complete file and all related documentation to finally determine the amount of the claim. A substantial amount: more than €25,000."
How was the collection procedure?
"We made the claim and collection known to the other party via a customised dunning letter. We received little to no response or payment to the demand letter we sent and the collection process actively pursued thereafter. Subsequently, the debtor engaged a legal expenses insurer. Initially, they tried to discuss the claim in order to then instigate legal proceedings. Eventually, the legal expenses insurer decided to cease its intervention which prompted Mariënbergh to continue the collection process. This then led to the total payment of the principal sum through a settlement. Irrespective of the terms of the general terms and conditions, we decided to moderate the costs. All in all, we were able to collect the total claim, including interest and costs."
It has been a long and intensive collection process. How did you manage to bring it to a successful conclusion?
"We had to conduct a very intensive debt collection procedure: lots of mail, phone calls, personal visits. All this to get and keep the debtor moving. Resulting in this success."
